Tiny house & building law

You have chosen the vagabundo Tiny House that suits you, add your own wishes and place your order. After production, your house will be delivered to the desired location and connected to the local supply network.


So far so simple, if there weren't another legal hurdle – the German construction law.


Unlike in the USA, where the Tiny House movement originated - whether small or large, in Germany you need a building permit as soon as you build or set up something. Wheels don't change that either. As soon as our houses are parked in order to live in them temporarily or permanently, they are no longer considered cargo, but are class 1 buildings according to the state building regulations. Early coordination with the local building authority is therefore highly recommended.

First of all, the requirements for the property must be met, i.e. a structural use for the purpose of living must be given. The development, the connection to the public road and path network, as well as the connection to the supply and disposal network are required, regardless of whether you are aiming for a self-sufficient supply or not.


If these requirements and the specifications for the distance areas anchored in the state building regulations are met, a simplified application for a building permit will be required for your project.


If you only want to use your vagabundo Tiny House as a holiday and weekend house, you can choose a specially designated special property (leisure property) that is used for recreation. These are often outside, surrounded by nature. According to the development plan, living in is then usually possible without a procedure or permit. However, use as a main residence is excluded here, unless the respective municipality expressly permits this in its development plan.
